We highly recommend monitoring the Visa Bulletin and Adjustment of Status regularly, as monthly updates can significantly impact your application strategy.
Key Focus for March in Employment-Based—EB-1A and EB-2 NIW Categories:
1/ In March, USCIS confirmed it will continue to use the Final Action Date chart. This means that only applicants with a priority date earlier than the listed date or marked as current (“C”) are eligible to file their Adjustment of Status applications.
2/ 1st Preference – EB-1 (Aliens of extraordinary ability, Outstanding Professors and Researchers, and Certain Multinational Managers or Executives):
- There are no retrogressions or changes compared to February.
3/ 2nd Preference – EB-2 NIW (Members of the Professions and Aliens of Exceptional Ability):
- There is some movement as detailed below:
- EB-2 India: Advances by more than six weeks to December 1, 2012;
- EB-2 China: Advances by two weeks to May 8, 2020;
- EB-2 Mexico, Philippines, and all other countries: Advance by six weeks to May 15, 2023.
