Every month, the Department of State releases the Visa Bulletin. This bulletin is crucial for individuals navigating the Green Card application process, as it determines the progression of the process.

We highly recommend monitoring the Visa Bulletin and Adjustment of Status regularly,  as monthly updates can significantly impact your application strategy.

Key Focus for March in Employment-Based—EB-1A and EB-2 NIW Categories:

1/ In March, USCIS confirmed it will continue to use the Final Action Date chart. This means that only applicants with a priority date earlier than the listed date or marked as current (“C”) are eligible to file their Adjustment of Status applications.

2/ 1st Preference – EB-1 (Aliens of extraordinary ability, Outstanding Professors and Researchers, and Certain Multinational Managers or Executives):

  • There are no retrogressions or changes compared to February.

3/ 2nd Preference – EB-2 NIW (Members of the Professions and Aliens of Exceptional Ability):

  • There is some movement as detailed below:
    • EB-2 India: Advances by more than six weeks to December 1, 2012;
    • EB-2 China: Advances by two weeks to May 8, 2020;
    • EB-2 Mexico, Philippines, and all other countries: Advance by six weeks to May 15, 2023.
