Every month, the Department of State releases the Visa Bulletin. This bulletin is crucial for individuals navigating the Green Card application process, as it determines the progression of the process.
We highly recommend monitoring the Visa Bulletin and Adjustment of Status regularly, as monthly updates can significantly impact your application strategy.
Key Focus for April in Employment-Based—EB-1A and EB-2 NIW Categories:
1/ In April, USCIS confirmed it will continue to use the Final Action Dates chart. This means that only applicants with a priority date earlier than the listed date or marked as current (“C”) are eligible to file their Adjustment of Status applications.
2/ 1st Preference – EB-1 (Aliens of extraordinary ability, Outstanding Professors and Researchers, and Certain Multinational Managers or Executives):
- EB-1 India: Advances by 14 days to February 15, 2022,
- There is no change for China and all other countries compared to March.
3/ 2nd Preference – EB-2 NIW (Members of the Professions and Aliens of Exceptional Ability):
- EB-2 India: Advances by one month to January 1, 2013,
- EB-2 China: Advances by approximately five months to October 1, 2020,
- EB-2 Mexico, Philippines, and all other countries: Advance by 5 weeks to June 22, 2023.
